Provincial Offences/Traffic Tickets

I provide Traffic Ticket paralegal services in Toronto.  Provincial Offences Act (POA) is a provincial statute that sets out procedures for the prosecution of offences under other provincial statues and regulation and municipal by-laws.

The Ontario Court of Justice hears provincial offence matters as well as municipal by-law offences.  Examples of such cases include:

  • Highway Traffic Act – speeding, seat belt, careless driving;
  • Municipal by-law charges relating to excessive noise, animal control or garbage disposal;
  • Charges laid under provincial legislation such as Environmental Protection Act, Occupational Health and Safety Act, Dog Owners’ Liability Act and the Trespass to Property Act.

Careless driving

A driver can be charged with careless driving if he or she drives a vehicle without due care and attention or without reasonable consideration for other persons using the highway.
If convicted you are liable to a fine of not less than $400 and not more than $2000 or to imprisonment of not more than 6 months or both. Your license may also be suspended for up to 2 years.

Speeding

Failure to drive within the posted speed limit could result in a fine. When receiving a speeding ticket, you need to worry about additional penalties such as increased insurance rates, license suspensions, and loss of demerit points for speeding over the limit by more than 15 km/hr.

Fail to remain

If you are involved in or are a witness to an accident you must remain at or immediately return to the scene of the accident; provide all possible assistance; and if requested, give in writing to anyone sustaining loss or injury or to any police officer or to any witness, his or her name, address, driver’s license number and jurisdiction of insurance, motor vehicle liability insurance policy number and policy number, name and address of the registered owner of the vehicle, and the vehicle permit number.

Penalties for a failing to remain charge include a fine between $400 and $2000, 7 demerit points, possible suspension of driver’s license (up to 2 years), possible jail time (up to 6 months), and an increase in insurance premiums.

No insurance

A person can be charged with operating a motor vehicle without valid insurance.  You may be liable to a fine of $5000 plus the 25% surcharge.

For a subsequent conviction, the penalty is $10,000 plus the 25% surcharge. Additionally, if convicted of this offence it may result in a potential 1-year driver’s licence suspension.

Cell phone

A driver is given a cell phone ticket when they hold or use a handheld wireless communication device or prescribed device that can receive or transmit telephone communications, electronic data, and mail or text messages. A cellphone violation can result in a fine of $490, three demerit points, a 30-day suspension for G1 and G2 drivers (a 60-day suspension if a G1 or G2 driver has a subsequent conviction), and increased insurance rates.

Fail to stop for police

Failure to stop for a police officer when signalled is liable to a fine of not less than $1000 and not more than $10,000, a jail sentence of not more than six months, or both. Additional penalties may include, increased insurance rates and seven demerit points on your driving record.
