BREACH OF CONTRACT

There are numerous causes of action that can trigger one to launch a civil suit. The most common is breach of contract. When an individual enters into a contract with another person or company, he/she expects that other party to fulfill his/her end of the contract. A failure to do so can result in a breach of contract.

A contract can be oral or written. But only a written contract can be used as material evidence. In order to defend the allegation of breach of contract, one can use affirmative defense. However, the parties should consult a legal professional before entering into a contract

DAMAGE TO PROPERTY

Damage to property could occur in many different circumstances. Examples of property damage or loss valued at under $25,000 may include:

Damage to windows, doors and interiors or exteriors of homes, apartments, cottages or businesses. Damage to automobiles.

SALE OF GOODS

Every time someone buys or sells goods, there is a sale of contract. The buyer agrees to buy goods at a specified price with specified standard of delivery and at a specified time. There are numerous legal issues associated with the sale of goods. Warranty is the obligation of the seller. On the other hand, the buyer has some responsibility in the sale of contract, such as, the buyers’ obligation to accept and pay for the goods.

Sometimes, sale of goods may occur under undue influence and duress. Buyer should be conscious about any transaction and deserves independent legal counsel to review the contract.

PROFESSIONAL NEGLIGENCE

Negligence of a professional person in carrying out the standard of practice or standard of care to clients/customers. The professional becomes liable to damage or injury caused by his or her failure to uphold the standard of care or standard of conduct. Professionals are required to carry the errors and omission insurance to meet such claims by their clients/customers.

For example, a lawyer who does not really know how to prosecute a case but takes the case anyway and does not adequately represent the client can be considered liable for professional negligence.

WRONGFUL DISMISSAL

In general, an employee has been wrongfully dismissed from a job without just cause. In this case an employer is obligated to give sufficient notice and financial remuneration to the employee in such cases. When the employer fails to live up this these obligations it becomes a legal matter. A wrongful dismissal will allow the employee to claim monetary damages.

CONSTRUCTION/RENOVATION

For example, you purchase a home and find out that there is mould growing in an area of the basement which could not have been uncovered by a regular inspection but the seller was actually aware of this issue and failed to disclose this fact.

Many people enjoy the benefits of loaning money from another. But when it comes time to paying back that loan, those same people are not as willing to pay back their dues. I can help you sue on your unpaid loans, obtain judgement and collect in enforcement.The Small Claims Court in Ontario allows for a lender to sue a borrower for the unpaid loans and also ask for reimbursement of legal fees.
